How Much Compensation Will I Receive?
A good question that’s difficult to answer early on. Many factors will, ultimately, contribute to the final value of your case. But, three important issues will directly impact the final outcome of your case: liability, damages, and the available insurance coverage.

Liability simply means, “who’s at fault”? Who caused the accident? Is more than one party at fault? Which party is most responsible? Least responsible? In most injury cases, fault is a question of negligence. Negligence, simply put, is carelessness; the failure to act reasonably and prudently.

Damages attempt to measure, in financial terms, the extent of harm inflicted on an injured person by someone’s negligent act; that is, the amount of the insurance claims settlement needed to restore the injured person to the position that person was in prior to being harmed.

As an injured accident victim, you may be entitled to recover damages for...

• Physical injuries(temporary or permanent)

• Scarring and disfigurement

• Humiliation, embarrassment and distress

• Psychological and emotional injury

• Pain and suffering

• Loss of enjoyment of life

• Medical expenses

• Lost wages

• Reduced earning capacity

• Lost profits

• Property damage

• Out-of-pocket expenses

The degree and permanency of your injuries will, in the end, be decisive in determining what damages you will be entitled to. That’s why it’s critical for you to allow adequate time for your injuries to heal before considering settlement. Once your condition has stabilized, we’ll review your treatment records. We’ll meet with your doctor for a report as to your current status, and what the future holds for you in terms of physical limitations and medical treatment.

The last consideration is the source of collection for damages; that is, where will the money come from to pay your loss? Usually, it lies with your offender’s insurance carrier. In some cases, your own insurance coverage will cover your losses. Accidents involving uninsured motorists fall into this category. The source of collection can become quite complicated. Every insurance policy is different. Provisions for payment are not always clearly defined. Recovering all your losses requires the skills only a lawyer, one specializing in injury law, can provide you.

Once we have this information, we’ll sit down with you and tell you what you should expect to collect as fair and adequate compensation for your injuries.

In the early stages of your case, no one can accurately predict how much your case is worth. Beware of any insurance adjuster, or lawyer, who tells you otherwise. When the dust finally settles, the extent and severity of your injuries, and the long term impact they have on your life, will finally determine the compensation you can expect to recover from your claim.
